§ 50-15. Possession of marijuana.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Aircraft includes every description of craft or carriage or other contrivance used or capable of being used as means of transportation through the air.

    Marijuana means all parts of plant of the genus Cannabis , whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture or preparation of such plant, its seeds or resin, but shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake or the sterilized seed of such plant which is incapable of germination.

    Vehicle includes every description of carriage or other contrivance used or capable of being used as means of transportation on or below or above the land, but does not include aircraft.

    Vessel includes every description of watercraft or other contrivance used or capable of being used as means of transportation in water, but does not include aircraft.

    (b)

    Unlawful acts. It is unlawful for any person to:

    (1)

    Possess or have marijuana under his control;

    (2)

    Transport, carry or convey marijuana in, upon or by means of any vessel, vehicle or aircraft;

    (3)

    Conceal or possess marijuana in or upon any vessel, vehicle or aircraft; or

    (4)

    Use any vessel, vehicle or aircraft to facilitate the transportation, carriage, conveyance, concealment, receipt, possession, purchase, sale, barter, exchange or giving away of any marijuana.

    (c)

    Penalty. On a first conviction for violation of this section with regard to marijuana, tetrahydrocannabinol or chemical derivative thereof, the offender shall be fined not more than $500.00, imprisoned in the parish jail for not more than 60 days, or both.
